Couple Killed in Dearborn Car Crash

A couple tragically died last Friday night in a Dearbon Michigan car accident. The husband and wife were driving south on Greenfield Road and apparently went through a blinking red light when they were struck by an undercover Dearborn police officer. The officer apparently did not have significant injuries. Police say that alcohol was not a factor in the accident.

If police reports are verified and the undercover officer was not negligent in his driving, the family of the deceased couple cannot pursue a wrongful death case against the officer or the police agency. In order to do so, it must be established that the officer somehow was negligent and caused the accident. If the deceased driver was at fault, the family of the deceased wife can still file a wrongful death case against her husband's insurance policy. This suit would be typically filed by children of the wife seeking damages for the loss of their mother. It does not matter if it was their father who was driving the car at the time of the accident.

The family of both decendents can still file a No-Fault claim against the insurance company for payment of funeral expenses, loss of services, and other allowable benefits. These benefits are owed even though the deceased driver caused the accident.
