A fatal Michigan truck accident occurred during the afternoon rush hour in I-94 yesterday. An 18-wheeler carrying a bridge section struck an overpass causing steel to fall on the cab of another 18-wheeler and killing the driver. At the scene the bridge section sat on the flatbed trailer that was hauling it. Auto parts littered the freeway. An unknown amount of diesel fuel also drained from the crushed truck.

Under Michigan law, the family of the 39 year old driver who was killed can file a lawsuit against the negligent truck driver and the trucking company. The family can seek damages for the loss of society and companionship, loss of services, loss of excess income, and many other claims under the Michigan Wrongful Death Statute. The family can also make a claim for No-Fault benefits for funeral expenses, lost wages, and loss of services. Additionally, the family may be able to make a worker's compensation claim. My firm handles truck accident cases throughout Michigan and many of these result in fatalities.
