Tragic Michigan Car Accident Death

A tragic Michigan car accident death case was reported today in the local papers. A twenty year old University of Michigan apparently was sitting behind the wheel of her car and was waiting for her mother to enter into the open passenger side door. The driver accidentally must have hit the accelerator and the vehicle fatally struck her mother. This sad case illustrates what we often see at my law office, which is simply devastating injuries caused by the slightest driver error or error in judgment.

Most car accident cases are just that, accidents. However, the law does impose legal duties on drivers to act with good judgment and sound driving principles and even in cases which "accidents," the negligent drivers can be held accountable for civil damages. In a case like I reported above, the decedent's family can actually file a claim against their own daughter for the mother's wrongful death. The car insurance company would have to pay the family a settlement for the wrongful death. This often sounds like a trivial solution but unfortunately the only remedy to an aggrieved family is monetary damagers.
