Carnival Ride Collapses and Injures 24

A California ride carnival collapsed and injured 24 riders yesterday. The Calaveras County Fair, near Sacramento, was busy with children and their families enjoying the rides and festivities when the carnival ride, The Yo-Yo, collapsed. This caused the seats of the ride to fall to the ground and resulted in injuries to the riders. The riders, mostly children, were taken to a local hospital.

With summer just around the corner, the attendance at county fairs, theme parks, and amusement parks will be at full capacity. Although most rides check out to be safe, it seems like every summer we hear of ride collapsing or serious injuries being reported from a defective ride. Persons injured on these types of rides do have legal rights against the fair operators and theme park owners and should contact an attorney immediately after the accident.

Originally posted at InjuryBoard by Daniel Buckfire

Child Lead Poisoning Verdict

A New York jury awarded $21 million to three children who suffered lead poisoning injuries as infants. The lead poisoning came from peeling and chipping paint at the rental home. The verdict was against the landlords. The children are in special education and have other behavioral problems. The health department inspectors found lead based paint hazards at the property.

This is a great verdict not only for these families, but for all other famililies who live in sub-standard housing because of their socioeconomic status. All too often around the United States, the landlords of these properties collect rent every month and provide little or no maintenance or upkeep to their properties. In MIchigan cities like Detroit, Flint, Saginaw, Muskegon, Grand Rapids, the number of children every year still being lead poisoning is staggering. The health departments are overwhelmed and understaffed and do not have the means to hold these negligent landlords accountable for poisoning children. It is really only the civil lawsuits, like the one in New York that wake up the landlords because their pocketbooks will be affected, and this is all they really care about anyways.

Originally posted at InjuryBoard by Larry Buckfire

Lead in Recalled Toys

There have been a number of toy recalls in certain months due to lead paint being identified on toys. The recalled toys have primarily been manufactured in China. While it is clearly a good thing to pull these toys from the shelves at retail stores and from homes, these actions alone will only have a minimal affect on the problem of child lead poisoning. The primary source of lead poisoning is still chipping and peeling paint in older homes throughout the United States and biggest efforts should be made to eliminating those hazards.

For more information on this subject matter, please refer to the section on Defective and Dangerous Products.

Originally posted at InjuryBoard by Larry Buckfire

Doctor Killed Beethoven With Lead Poisoning

"His death was due to the treatments by Dr. Wawruch," said Reiter, head of the Department of Forensic Medicine at Vienna's Medical University. "Although you cannot blame Dr. Wawruch -- how was he to know that Beethoven already had a serious liver ailment?"

A Viennese pathologist believes that Beethoven was inadvertently killed by his doctor and the cause of death was lead poisoning. Other scientitists and researchers are not supportive of this opinion. Researchers have previously believed that Beethoven died from lead poisoning at age 57 based upon toxic levels of lead found in his hair and bone fragments.

Viennese forensic expert Christian Reiter claims to know more after applying CSI-like methods to strands of Beethoven's hair. He believes that the composer's physician used treatment containing lead on his patient and this contributed to his death, along with his failing liver. This would of course make a very interesting CSI medical malpractice case for providing treatment that contributed to the death of his patient.

For more information on this subject matter, please refer to our section on Wrongful Death.

Originally posted at InjuryBoard by Larry Buckfire

Lead Poisoning is Top 5 Yahoo Search

Although the problem of child lead poisoning has been a top environmental health issue for over two decades, it has really jumped right into the news headlines with the recent Mattel toy recall. In fact, the search terms "Lead Poisoning" are the number five search term on Yahoo today. Although no cases of lead poisoning have been specifcially linked to the recalled toys, the public awareness that the recall has rasied is tremendous. Parents are now requesting more information about the disease and are taking measures to ensure that their children live in a lead safe environment.

My firm specializes in child lead poisoning cases throughout both Michigan and Ohio. Our cases are primarily against landlords who fail to maintain the paint in their property and contractors, like window replacement companies, who do not use lead safe practices.

For more information on this subject matter, please refer to the section on Defective and Dangerous Products.

Originally posted at InjuryBoard by Larry Buckfire

Toymaker Sued over Lead Paint Recall

A lawsuit was just filed by a Florida parent againt Mattel aftre the company recalled 1.5 million toys with possible lead paint hazards. The parent is seeking a refund for toys and money for diagnostic tests for lead poisoning.
Fisher-Price recalled the preschool toys on August 1 because their surface paint could contain excessive amounts of lead. The toys, such as Dora the Explorer and Sesame Street characters, were made in China.

My firm represents lead poisoned children in cases throughout Michigan, Ohio, and several other states. We have received several call regarding the toy recalls and are investigation possible poisonings related to those toys. I am not aware of any cases to date that have placed the source of a child's poisoning to a toy alone.

For more information on this subject matter, please refer to the section on Defective and Dangerous Products.

Originally posted at InjuryBoard by Larry Buckfire

Mattel Toys Recalled Due to Lead Poisoning Hazards

I have blogged recently about toy and other product recalls due to possible lead poisoning hazards. Yesterday, the biggest recall of toys in recent memory was announced. Toy maker Mattel announced a recall of 1.5 million toys made in China due to possible lead hazards. The recall includes some Sesame Street toys, Go Diego Go toys, and other popular child toys. The recall is expected to cost Mattel approximately $30 million dollars.

Lead is known to cause permanent and irreversible neurological damage to young children. It is ingested either by placing the toys in the child's mouth or from lead dust on the toys that is ingested through normal hand to mouth contact. As of this writing there are no known poisonings from the toys and it is hopeful that the recall will reach parents before any children are poisoned.

For more information on this subject, please refer to our section on Defective and Dangerous Products.

Originally posted at InjuryBoard by Larry Buckfire

Child Lead Poisoning Rules Get Tougher

Due to the significant number of children in Cincinnati diagnosed with lead poisoning every year, the city instituted new rules for providing health education and inspecting high risk properties. The primary source of child lead poisoning is deteriorated paint in older buildings. The city health department will now send a nurse to homes to educate parents when blood lead levels between 5 and 9 ug/dl. The Center for Disease Control defines any level greater than 9 ug/dl in a child as lead poisoning. The goal is to educate parents and implement hazard reduction measures before levels get to a dangerous level, rather than wait until they get too high and then begin the intervention process.

My firm handles child lead poisoning cases throughout Michigan and Ohio. We proudly represent lead poisoned children and their families against negligent landlords and property managers.

For more information on this subject, please refer to our section on Toxic and Hazardous Products.

Originally posted at InjuryBoard by Larry Buckfire

EPA Fines Landlord for Lead Poisoning Violations

The EPA recently levied huge fines against a San Diego landlord for failing to provide tenants with the federally mandated lead paint poisoning pamphlet and disclosure form. Under the terms of a settlement ,Sunview Properties must spend $216,664 in lead paint removal and pay a $31,000 fine over alleged violations of the Residential Lead-Based Paint Hazard Reduction Act in connection with the leasing of 25 rental units located in San Diego, Calif.

Child lead poisoning is the most serious environmental health threat to children in the United States. Lead poisoning causes permanent and irreversible brain damage and neuroligcal damage that affects a child's ability to succeed in school and is known to cause behavioral problems, including ADHD and delinquency.

My firm is among the elite firms in the United States handling cases against landlords on behalf of lead poisoned children. We handle these cases primarily in Michigan and Ohio but frequently associate with firms in other states to handle these cases.

Originally posted at InjuryBoard by Larry Buckfire
