Wal-Mart Sued For Gun Case

I am often asked whether a retailer can be sued for selling guns to a person who uses them to commit crimes. This depends on the circumstances of the sale and the nature of the crime. It also depends on the laws of the state where the sale and the crime took place.. In general, the retailer may be held liable if it sold the weapon in violation of laws and regulations regarding the sale of the weapon. In New Mexico, a lawsuit was filed against Wal-Mart for selling ammunition to an unstable man who then used the it to murder another man. The dead man's family filed a wrongful suit against the retailer. It will be interesting to see how this one plays out. Stay tuned.
