A tragic story was in the Monroe News last Saturday about a biker who was killed when his motorcycle left the roadway and he was thrown from the bike.  Douglas Cunningham died in the accident.  Police say that speed was most likely not a factor in the accident.  Mr. Cunningham died after leaving the memorial service of a fellow biker who had died just a few days earlier.

Now that the weather is warming up, more and more bikers are taking their motorcycles to the road.  Unfortunately, this often means more motorcycle accidents and more tragic deaths.  Despite the common perception that most motorcycle accidents are the fault of the bikers, the fact is that most biker accidents are caused by other motorists and truck drivers who ignore the rights of the bikers and cause these accidents.

Attorney Daniel Buckfire from my firm handles a number of motorcycle accident cases and he rarely ever sees a case where the biker was at fault in the accidenty.  He says, "Typically, you see a biker in his own lane of traffic being struck or forced off the road by a motorist or truck driver simply not paying attention.  The results are often tragic and deadly."

In those cases, the biker or his family can file a lawsuit against the negligent driver that caused the accident.  Also, quite often the biker can make a claim for Michigan No-Fault Benefits to recover medical bills, lost wages, and other types of benefits.  In cases involving death, a wrongful death suit can be filed on behalf of the biker's family.
